What factors will be relevant in resolving this dispute and how will Essay

What factors will be relevant in resolving this dispute and how will they be applied by the court in this case - Essay Example Of course, Kev does hold ownership of the mansion and can enjoy the profit from it if any. However, he is not entitled to sell it or insist Agatha to vacate the mansion. Also, section 12 of the Act states that â€Å"beneficiary is entitled to an interest in possession in land subject to a trust of land is entitled by reason of his interest to occupy the land†1. Section 14of the Trust of Land and Appointment Trustees Act 1996 specifies court’s power in preventing the disposal of property. The law further denotes that selling the property should be â€Å"free of any equitable rights† which does not apply in this case. Similar to this case, a recent judgment on a case study of Jones v Kernott (2011) UKSC 53 reveals the fact that the person’s interest on the property should be recognized and fulfilled as he has 50:50 share or ownership on land or property2. Hence, in this case Agatha has to make only certain amount of compensations if Kev does not experience any benefit from the property. No law of the country would ever prevent her from staying at the mansion for the rest of her life. A jury would always observe a person’s state of mind, intension, and whether it hurts any of the partners in some ways or other. In this case, Agatha’s desire to remain in rambling mansion has to be accepted, because she as the co-owner and an aged woman deserves caring consideration for every cause. On the flip side, when one considers the demand of Kev, his claim does not point to any loss he experiences because of Agatha’s stay. Since he does not have a clear reason to support the immediate sale of the mansion, his argument would not sustain in the court of law. TLATA always intends to ensure peace and harmony. Agatha may have to make certain level of compensation if Kev proves that he does not get any benefits from the mansion. But such claims of Kev should have valid proofs and

Ways for Organizational Assessment: Human resource department of Masood textile Mills Ltd. uses evaluation forms to assess the performance of MT officers. IMPROVEMENT IN HR PERFORMANCE First we will talked about the challenges and problems faced by mTm then solution to that problems and challenges. The HR manager of Masood Textile Mills Ltd. is continuously striving for making parallel the needs of the changing organization so that it can become more adaptable, resilient, quick to change directions, and customer-centered. Within this environment, the HR professional are learning how to manage effectively through planning, organizing, leading and controlling the human resource and knowledge of emerging trends in training and employee development. Followings are the human resource challenges in Masood Textile Mills Ltd.: 1) Rapid Change: The internal environment of the organization is changing very rapidly because of noise of the machines, high temperature where product is produced, quality control and cultural environment of the organization. The external environment of the organization is change in the technology, economic factors and industry based products. 2) Work Force Diversity: The values, norms and attitudes of the workers are not homogeneous so the workers have to be trained by the different kinds of courses which relate to the work force diversity. The dimensions of workplace diversity include: age, ethnicity, ancestry, gender, physical abilities/qualities, race, sexual orientation, educational background, geographic location, income, marital status, military experience, religious beliefs, parental status, and work experience. 3) Legislation: The rules and regulation, government policies, contract act, services act and taxation laws are being changed every year so MTM must be updated with them. 4) Competitive Challenge: The competitive edge of the organization is Cost, Quality and Availability of the goods. So, MTM has to be updated according to customer preferences and competitors technologies for improving qualities and reducing costs. Human Resource Problems Although there are many HR problems in MTM as we have visited the human resource department yet the most identifiable was that of downsizing of employees. Masood Textile Mills have been using the downsizing strategy in order to cover its budget and to cut down the costs that become high due to increase in the pays of operational level employees. MTM has increased the salaries of low level production workers from Rs. 3,000 to Rs.4,000. In this way the budget increases and MTM has to cover up so, it used to downsize the employees. Downsizing Impacts Overall: It is effecting the overall economy as more people are downsized the un-employment persist in the economy. Mixed effects on firm performance: some short-term costs savings, but long-term profitability valuation not strongly affected. Firms reputation as a good employer is suffering. Downsizing Effects on Employee Morale: Employee motivation disrupted: increase in political behaviors, anger, fear which is likely to negatively impact quality of customer service Violation of psychological contract, leads to cynicism, lowered work commitment, fewer random acts of good will Survivors experience more stress due to longer work hours with re-designed jobs, and increased uncertainty regarding future downsizings. Solutions to Downsizing: Employment  Changes in  Pay/Benefits can be an effective alternative to downsizing. Outplacements can be another good alternative to downsizing in which organization help present employees find new jobs with other firms. Attritions which mean the voluntary departures of employees must be encouraged in this situation. Voluntary Quits  by employees must be appreciated. Offer voluntary early retirement or other packages to people within a certain category, such as particular position or years of service. If this offer does not result in enough savings, it is extended to a broader pool. Offer early retirement incentives to pension-eligible employees in a specific area. If that doesnt get sufficient response, expand the pool and so on. Hiring freeze can be done by not allowing job openings fill with external employees. Internal job recruitment by succession planning can be done in order to fill new job opening.    Relocation  can be done by sending the employees overseas to another branch of MTM where there is HR shortage instead of hiring new employees there. It would definitely cut costs. Voluntary  Pay cuts of employees can be done by making sure that they will get the accumulated pay at the end of year with some increment in it. Involuntary Separation policies must be strict enough to maintain employee commitment to organizational policies and in case of dis-obey must be separated.   Early Retirements can be granted to employees. Organization may include the golden handshake benefit. Temporary Layoffs  can be done. This will help organization to maintain its employee loyalty and also cut down its work force for some period. Other implications to improve HR performance: Successful organizations have a focus on the performance of their employees. Here employees are rewarded based purely on their performance on set criteria. Their performance goals and targets are clearly defined and communicated to them in a formal way. The employees feel motivated and accountable for their performance and strive to achieve/exceed the targets set for them. The only thing that pleases the managers and leadership is higher achievements and performance delivery. Regular Feedback to Employees. Supervisors must have to get feedback on regular basis from workers. This feedback should be on day to day basis to improve the current targets rather than to to rectify the errors / mistakes of past. This approach needs to observe and evaluate the efficiency of employees. This is also ensure that the manager also involved to give positive feedback for the job well done. Authoized overtime payment: The surest way to aggravate a wage and hourly claim is not to pay overtime to those employees who have worked. The Department of Labor (DOL) regulations has been clearly mad that if you know that an employee had worked more time than is scheduled, you must paid him, even if you did not depute him for additional work. Exempted employees treat properly: Employers expects that their exempt employees (those exempt from the overtime provisions of the Fair Labor Standards Act (FLSA)) to worked as long as the job done. Some of the employers also punish their exempted employees to do work for paid vacation or sick time. Review HR policies and procedures. There should be clearly written policies can be both effective employee relationship. The policies that are out of date applied improperly should have opposite effect. There should be regular review of policies that should be matched with new laws, rules regulations.Experts suggest that a thorough review of policies should be made once a year.

Fall Of Romanian Republic And Julius Caesar History Essay

When people imagine a great imperium, most think of Rome. The Romans had great thoughts and programs which would hold made any current imperium seem bantam. From the great enlargement led by consummate tacticians to the immensely progress authorities which our authorities is modeled after today, the Romans had a fantastic hereafter, if non for its many defects. The early enlargements led to the separation of an already seesawing societal category, the authorities had many holes which rewarded the wealthy and the greed of Lords and people of power weakened a authorities which could hold been to the full polished. The rise of Julius Caesar after the agreement with Pompey would hold been longer lived if the senator ‘s powers were n't relinquished for the â€Å" better of the people. † All of this and more would finally take to the autumn of the Roman Republic and subsequently the Roman Empire. There were many factors which led to the autumn of the Roman Republic which inclu de the battle of authorities breakability, the negative influence of the Gracchi, the First Triumvirate and the absolutism of Julius Caesar. To understand how Rome finally fell, one must get down before the little city state grew. After the concluding Roman male monarch was exiled, Rome attempted to construct a little, but slightly effectual authorities described as an oligarchy or ruled by â€Å" few † ( Asimov 28 ) . As a Republic, the Romans gave power to a leader by electing him into office, similar to what we do today. This official, known as the pretor, was kept in cheque by another pretor who was in office. Efficaciously, nil would go on unless both wholly agreed on an issue which better notes their place as consuls. Today in the American authorities, there are three subdivisions ( Executive, Legislative and Judicial ) which appear to be efficient plenty to properly â€Å" look into † each other. Like our executive subdivision, the Roman consuls were in charge of the military and led them into conflict ( Asimov 24-25 ) . Similarly to the American Judicial subdivision, Romans had their ain Judgess call ed quaestors which overlooked all of the tests. This was the beginning of a suited system of regulating, but the issue was the people who could be elected to keep these places were of a certain category. The two chief societal categories in the early Roman Republic were the patricians and the plebeians, plebs for short. The patrician category consisted of Lords and wealthiest land proprietors. The plebs were the mundane societal category of normal, mundane citizens which included merchandisers, workers, and the hapless. During the beginning of the immature authorities, the lone people who could be elected into the taking places were the patricians. This restriction of power led to a split in the two categories. Basically, the voice of all was non heard because merely the patricians were able make of import determinations affecting mundane activities and lawmaking. Not merely was the state of affairs unfair, but the deficiency of attention for all citizens increased the separation of categories. The illustration Asimov gives is this: â€Å" Why should the patrician attention? He was good plenty off to last the difficult times. And if a common husbandman went into debt, the debt Torahs were so rough that the plebeian would hold to sell himself and his household into bondage to pay off the debt. It would be the patrician landholder to whom he was in debt and for whom he must so break one's back. ( 29 ) This deficiency of attention forced the plebs to seek alternate manner of life. In 494 B.C. , a big population of plebs left Rome to make their ain authorities. This move initiated the patricians to compromise with their overpoweringly big populations of plebs. This via media gave the plebs a voice in the authorities, but was still really limited. The new voice of the plebs were the tribunes. These elected functionaries merely represented other plebeians and could merely voice their sentiment on public issues. The add-on of these new functionaries added another cheque to equilibrate Roman authorities. An illustration of this was the freshly added ability of the tribunes veto an unjust jurisprudence ( Asimov 30 ) . Although it appeared the Roman Lords attempted to be more just, the greed and â€Å" loss of power † to the tribunes made internal discord evident. The tribune ‘s safety became more a big issue after the incident with Coriolanus incident. These and similar events led to the codification of Roman jurisprudence in 450 B.C. This was an effort to forestall the patricians in senate from â€Å" flexing the jurisprudence. † Besides, it gave the tribunes the ability to support both themselves from the unjust advantages established by the patricians and their lives. Ten patrician work forces, called decemvirs, were elected to keep power until the Torahs were finished. The new Torahs were written on bronzy tablets and were therefore called the Twelve Tables which was the foundation of their jurisprudence ( Asimov 32 ) . Again, the adaptative ability of the Romans resulted in another reasonable solution. Whenever a job arose, they were able to decide the issue. The inquiry so is why were at that place so many issues during this epoch? Even after they moved on to a apparently better authorities, the patricians and plebeians arrived at another route block. The decemvirs, harmonizing to Roman tradition, stayed in power even after the Torahs were written. More issues that revolved around the battle of entire control plagued the senate. Again the plebeians wanted to go forth because of these events, but big part of the population forced the patricians to listen and the decemvirs relinquished their place. Soon power would be more equally spread as the plebeians place to better influence legislation increased and the integrating of the two categories in matrimony allowed the less fortunate more chances ( Asimov 33 ) . With more and more chances to go a stable and just authorities, Rome was on the right way. Although they took a measure in front in their adulthood, there was a important reverse many historiographers believed contributed to the autumn of Republic. Tiberius and Gaius Gracchus, better known as the Gracchi, were two brothers who sought extremist reform which many believe increased tenseness in the senate and diminished power due to a big separation of thoughts. Their male parent was both a politician and military leader, which theoretically gave them the tools to win. After his decease in Spain Cornelia, the Gracchi ‘s female parent, made certain her boies were knowing citizens before they were combatants. Her dedication to her lone â€Å" gems † would craft the foundation of a politically strong, but socially destructive dreamers. The older Gracchi, Tiberius, initiated the way to reform after witnessing the horrors of unfairness and societal inequality in Rome. In 134 B.C. he was elected as a tribune and his first effort to convey equality was the thought of a land reform. Basically, his program was to do the available land more evened out to all citizens of Rome ( Asimov 138-40 ) . Although this was a healthy progr am for the plebs, the job began with the current landholders. The patricians, both in senate and out, were angered by this impression. Although there technically was a jurisprudence which supported Tiberius ‘ reform, the affluent patricians would lose a great part of their land ( Asimov 139 ) . To protect their land, his oppositions used their governmental system and pecuniary strength to derive an advantage. Since no new jurisprudence would be pass if a veto by the tribune party was raised, their scheme was to purchase their manner into protection. The other tribune at the clip was a adult male name Marcus Octavius, who was believed to be a friend of Tiberius. After a few payoff from the patricians, Octavius proved to be a friend merely to the highest bidder. The usage of his power to blackball successfully prevented the new reforms to be passed. This caused Tiberius to gesticulate the remotion of his former friend and co-tribune. In fact, this improper move granted the senate more grounds to take this extremist. His decease was at hand after his term so he attempted to hold himself reelected illicitly. This ended ill due to his oppositions claim of Tiberius ‘s effort to be a sovereign. The Republic would hold nil to make with this once more, so Tiberius did non go a tribune once more. After he lost his place in the senate, he was viciously murdered by his oppositions and dumped into the Tiber River ( Asimov 140-41 ) . Finally, Gaius played an of import function for the reformists. After his brother ‘s decease, he was elected a tribune a

Media – Pre production piece, storyboard for music video

In order to make my storyboard I had to research many different music videos. I looked at music videos from many different music channels and from many different musical genres, such as rock, pop and hip-hop. After analysing these videos I came to the conclusion that there were a number of important points I had to consider when making my storyboard. I decided to use Bob Dylan's ‘Blowin' in the wind' for my music video storyboard as there was never a video created for it. Also I think the issues of war in the song are very topical to the current affairs in the world today. Firstly, something I had to consider carefully was my audience. The song I chose was released in the 1960s. So, obviously it would not significantly appeal to the younger age groups. The majority of my audience will be of the older age group, probably between 40 and 60. This song would appeal to both men and women, so there was no particular gender to target. I do not think that this song would attract any particular class of people, as the song discusses issues that affect all social classes. Furthermore, I had to consider the length of each frame, as it must coincide with the rhythm of the music playing. For example, if I were to make a storyboard for a slow song then I would most probably have long frames of about 4 seconds. Whereby on the other hand if I were to make a storyboard for a fast song then I would most probably have short frames of about two seconds. So, in my case I chose to use long frames to capture the slow, mellow rhythm of the song. Another point to deliberate was whether to follow the words of the song in my storyboard or to use a number of interesting images linked together which don't have much relevance to the song. I decided to use the words of the song in my storyboard to convey what the song was about. Some of the words in the song were ambiguous, but I conveyed what I felt the words meant. All of the images are outside and most are linked with nature. I chose to do this to give the video a relaxing and peaceful theme, to fit in with what the song is about. This is also linked in with my target audience, as I tried to achieve a calm video, something that someone of the older generation would enjoy watching and would help relieve them of stress. I decided to repeat the same images in each chorus to reinforce the meaning and importance of the words. Furthermore, I also chose to repeat the same images in each instrumental section of the song. I chose the image of the sun going down, from morning, to afternoon, to evening, to dusk; I did this to create the affect that one verse was over and the next was beginning. I also used it at the end to indicate the song was ending, as the day was ending.
